Grandparent Rights

Grandparent rights are somewhat limited in the State of Ohio.  Nonetheless, there are situations in which the circumstances are such that it is in the child’s best interest to be placed in the care or custody of a grandparent.  Grandparents may also be able to obtain court ordered parenting time.  If you are a grandparent, we can help you determine your legal rights in connection with your grandchildren.

Domestic Violence

If your spouse, child or other family household member presents an immediate risk of harm to you, another family member or your property, you may be able to obtain a civil protection order or “CPO”.  The CPO will require the offender to be restraining from coming around you, your home or your place of employment for a certain period of time.  Going through a divorce or dissolution is very emotional.  This stress can cause a hostile home environment that is unsafe for your or your other household family members.  We can help you determine whether or not you may have cause to obtain a CPO and how that may impact your legal rights and responsibilities.

Spousal Support

Spousal Support also referred to as “alimony” is often associated with long term marriages and significant disparities in income or earnings ability.  However, there are numerous factors that must be analyzed to properly evaluate whether or not you are entitled to or obligated to pay spousal support.   Unlike child support, Ohio does not have a worksheet or formula for determining the amount or duration of spousal support.  You will want the expertise of a family lawyer to assist you in evaluating your rights and responsibilities in this regard.

Child Support

In Ohio, Child Support is determined by using a worksheet, much like a tax return.  The worksheet analyzes your relevant information and then calculates the proper amount of support.  There are numerous factors that impact the data that is put into the calculation.

Whether you are seeking sole custody or shared parenting, the ultimate goal is to have an agreement or obtain a court order that is in the best interest of your children.  Sometimes, parents are unable to agree upon what is best for their children.  In that case, you will need to have the court make a determination.  Our family attorneys are prepared to discuss and help you analyze your legal rights and responsibilities related to the custody and care of your children.

High Net Worth Divorces

Ohio Law is clear:  In an action for Divorce or Dissolution, all marital assets and debts are to be divided evenly, unless doing so is unfair for some reason.  High Net Worth Divorces are no different than any other case, except they can sometimes present complicated issues related to identifying all of the actual assets of the marriage and determining the values of the various assets along with the tax consequences of proposed divisions of those assets.

We work closely with our clients and other professionals (if necessary) to achieve a fair and equitable division of the marital assets and debts and any support issues.

Divorce and Dissolution

There are two ways to terminate your marriage in the state of Ohio:  Divorce and Dissolution.  Our Cincinnati, Divorce Lawyers will work with you to explore and determine which process will help you achieve your goals in the most efficient manner:

Dissolution of Marriage:

This is essentially an agreed upon Divorce.  You and your spouse must agree upon all of the terms:  Division of Assets and Debts, Custody, Support, Attorney Fees and Court Costs.  Once you have agreed to all of these terms, you can enter into a Separation Agreement or Shared Parenting Plan and then Petition the court jointly to terminate your marriage.  This is normally a quicker and cheaper way to terminate your marriage.  Contact one of our family attorneys today to discuss the possibility of terminating your marriage by dissolution.

Divorce:

If you are unable to agree on all of the terms of the division of assets and debts, custody, support, attorney fees and court costs you may have to file for Divorce.  This is a legal action to terminate your marriage.  Unless you work out a settlement after filing for divorce, the court will determine those issues that you and your spouse are unable to agree upon.  Some clients are forced to file for divorce to secure parenting time, support payments, payment of debts or to simply make sure their marital assets are preserved.  Contact one of our divorce lawyers to discuss and evaluate your need for immediate court action.
